Information About Recent Amendment

Instrument LIN 19/046 is presented below the subregulation 2.07(5) to the Regulations of Migration 1994. The instrument revokes LIN 18/090 (F2018101194) the former law following Interpretation Act 1901 (the AIA) subsection 33(3) of the Acts. 

The instrument works to define the approved place and approved form and method of lodgement for an appeal for a Medical Treatment (Visitor) (subclass 602) (Class UB) Visa to be acceptable.

Purpose of the Instrument

The goal of the instrument is to give the approved place and method for producing an application for Medical Treatment Visa. From 2 Mar 2019, the authorized form can be lodged utilizing the 48ME online form or by the 48ME paper form method that existed below the former law. The lodgement of the non-internet appeal by presenting a 48ME  paper form will be under the directions given by the Home Affairs Department either verbally or by email.

Following Legislation Act 2003 subsection 17(1), consultation was engaged with external and internal stakeholders. External consultation involved in the engagement with affected stakeholders as below:

a. service delivery partners – meetings involved in directing the ways to manage the consequence of the change from the lodgement of paper form; and

b. Organizations in the medical aid category, along with appropriate overseas posts.

The Best Practice Regulation Office (O.B.P.R) has suggested that a Statement on Regulatory Impact is not needed 24704.

Below the section 10 of the Legislation (Exceptions and Other Matters) Regulation 2015, the instrument is excluded from disallowance, and therefore a Compatibility Statement with Human Rights is not needed. The instrument starts on 2 Mar 2019.
